Terms and Conditions
1. Acceptance of Terms
By accessing or using the ServiceEdge Marketing platform ("Platform") and its services, you agree to comply with these Terms and Conditions ("Terms"). If you do not agree, please refrain from using the Platform. We may update these Terms at any time. Continued use of the Services confirms your acceptance.
2. Services Provided
a) Right to use. We grant you the right to access and use the Services in accordance with this Agreement.
b) ServiceEdge Marketing offers subscription-based access to AI Marketing and Voice Agent software-as-a-service (SaaS) products built and manufactured by our OEM partners, Zoho.com, GoHighLevel, VoiceGenie and CloserX.ai. These SaaS subscriptions are provided "as-is" and are separate from other services offered by ServiceEdge Marketing, such as marketing consulting. Features and details of these subscriptions are available on our website and are subject to change.
c) Our Consulting Plan: Provides 5 consulting hours to support the strategic & executional deployment of the AI Voice Agent SaaS solution, including campaign planning, AI Voice Agent & script development, execution management, and performance optimization of the SaaS solution.
d) Manner of use. You may not:
i. reverse engineer, decompile, disassemble or work around technical limitations in the Services, except to the extent that applicable law permits it despite these limitations;
ii. disable, tamper with or otherwise attempt to circumvent any mechanism that limits your use of the Services;
iii. rent, lease, lend, resell, transfer, or sublicense any Services or portion thereof to or for third parties, except as explicitly permitted herein or in license terms that accompany any Services component;
iv. use the Services for any purpose that is unlawful or prohibited by this Agreement; or
v. use the Services in any manner that could damage, disable, overburden, or impair any ServiceEdge Marketing services, or the network(s) connected to any ServiceEdge Marketing services, or interfere with any other party’s use and enjoyment of any Services.
vi. Updates. We may make changes to the Services from time to time, including: the availability of features; how long, how much or how often any given feature may be used; and feature dependencies upon other services or software.
vii. Preview features. We may make features available on a Preview basis. Previews are provided “AS-IS”. Previews may be subject to reduced or different security, compliance, privacy, availability, reliability, and support commitments, as further explained in the Privacy Statement, and any additional notices provided with the Preview. We may change or discontinue Previews at any time without notice. We also may choose not to release a Preview into “General Availability”.
3. Using the Services and Support
a) ServiceEdge Marketing Account. You’ll need a ServiceEdge Marketing account to access many of the Services. Your ServiceEdge Marketing account lets you sign in to products, websites and services provided by ServiceEdge Marketing and some ServiceEdge Marketing partners. You are responsible for maintaining the confidentiality of your account information and all activities under your account.
b) Creating an Account. You can create a ServiceEdge Marketing account by signing up online. You agree not to use any false, inaccurate or misleading information when signing up for your ServiceEdge Marketing account. In some cases, a third party, such as your Internet service provider, may have assigned a ServiceEdge Marketing account to you. If you received your ServiceEdge Marketing account from a third party, the third party may have additional rights over your account, such as the ability to access or delete your ServiceEdge Marketing account. Please review any additional terms that the third party provided you with, as ServiceEdge Marketing has no responsibility regarding these additional terms. If you create a ServiceEdge Marketing account on behalf of an entity, such as your business or employer, you represent that you have the legal authority to bind that entity to these Terms. You cannot transfer your ServiceEdge Marketing account credentials to another user or entity. To protect your account, keep your account details and password confidential.
c) Account creation. If any of the Services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information. You must be the age of consent or older to create an account. You may not select an account user name or identifier that impersonates someone else, is or may be illegal, or may be protected by trademark or other proprietary rights, is vulgar or offensive or may cause confusion. We reserve the right to reject and/or reassign these user names and Service identifiers in our sole discretion. Each individual is entitled to one account to use with these Services and a user may not register for an additional account using other information. If a user creates multiple accounts, ServiceEdge Marketing may suspend or delete such additional accounts at its discretion.
d) Responsibility for your accounts. You are responsible for: any and all activities that occur under your account; maintaining the confidentiality of any non-public authentication credentials associated with your use of the Services; and promptly notifying our customer support team about any possible misuse of your accounts or authentication credentials, or any security incident related to the Services.
e) Account Use. You must use your ServiceEdge Marketing account to keep it active. This means you must sign in at least once in a two-year period to keep your ServiceEdge Marketing account, and associated Services, active. If you don’t sign in during this time, we will assume your ServiceEdge Marketing account is inactive and will close it for you. If we reasonably suspect that your ServiceEdge Marketing account is at risk of being used by a third party fraudulently (for example, as a result of an account compromise), ServiceEdge Marketing may suspend your account until you can reclaim ownership. Based on the nature of the compromise, we may be required to disable access to some or all of Your Content. If you are having trouble accessing your ServiceEdge Marketing account, please contact us.
f) Children and Accounts. By creating a ServiceEdge Marketing account or using the Services, you accept and agree to be bound by these Terms and represent that you have either reached the age of “majority” or “legal responsibility” where you live or your parent or legal guardian agrees to be bound by these Terms on your behalf. If you do not know whether you have reached the age of “majority” or “legal responsibility” where you live, or do not understand this section, please ask your parent or legal guardian for help. If you are the parent or legal guardian of a minor, you and the minor accept and agree to be bound by these Terms and are responsible for all use of the ServiceEdge Marketing account or Services, including purchases, whether the minor’s account is now open or created later.
g) Closing Your Account. You can cancel specific Services or close your ServiceEdge Marketing account at any time and for any reason.
h) Moderation and Enforcement. Many of our Services that allow you to interact, create, generate and share content with others leverage safety systems to protect our Services and other users.
i) Policies. Our Privacy Policy identifies what’s prohibited when using our Services. Our content and conduct policies can be found here (https://www.serviceedgemarketing.com/privacy-policy).
j) Reporting a Concern. You can report concerning content or conduct that may violate our Policies here (https://www.serviceedgemarketing.com/contact-us).
k) Review. Where applicable, we may use automated systems and humans to review content to identify suspected spam, viruses, fraud, phishing, malware, jailbreaking or other illegal or harmful content or conduct.
l) Enforcement. We reserve the right to deny content if it exceeds limits on storage or file size allowed by the Service. We may block, remove or decline to display content if it appears to violate our Code of Conduct or another Service policy or where required by law. If you violate these terms or Privacy Policy (https://www.serviceedgemarketing.com/privacy-policy), we may take action against your account. This could include limiting access to certain features or Services, stopping providing Services, closing your ServiceEdge Marketing account immediately or blocking delivery of a communication (such as email, file sharing or instant message) to or from the Services. Closure of your access to a Service or your account may result in forfeiture of content licences, associated content, memberships and ServiceEdge Marketing account balances associated with the account. When reviewing alleged violations of these Terms, ServiceEdge Marketing reserves the right to review content to resolve the issue. However, we cannot monitor the entirety of the Services and make no attempt to do so.
m) Work or School Accounts. You can sign in to certain ServiceEdge Marketing services with a work or school email address. If you do, you agree that the owner of the domain associated with your email address may be notified of the existence of your ServiceEdge Marketing account and its associated subscriptions, control and administer your account, and access and process your Data, including the contents of your communications and files, and that ServiceEdge Marketing may notify the owner of the domain if the account or Data is compromised. You further agree that your use of the ServiceEdge Marketing services may be subject to the agreements ServiceEdge Marketing has with you or your organisation and these Terms may not apply. If you already have a ServiceEdge Marketing account and you use a separate work or school email address to access Services covered under these Terms, you may be prompted to update the email address associated with your ServiceEdge Marketing account in order to continue accessing such Services.
n) Additional Equipment/Data Plans. To use many of the Services, you’ll need an Internet connection and/or data/mobile plan. You might also need additional equipment, such as a headset, camera, telephone or microphone. You are responsible for providing all connections, plans and equipment needed to use the Services and for paying the fees charged by the provider(s) of your connections, plans and equipment. Those fees are in addition to any fees you pay us for the Services, and we will not reimburse you for such fees. Check with your provider(s) to determine if there are any such fees that may apply to you.
o) Service Notifications. When there’s something we need to tell you about a Service you use, we’ll send you Service notifications. If you gave us your email address or phone number in connection with your ServiceEdge Marketing account, then we may send Service notifications to you via email or via SMS (text message), including to verify your identity before registering your mobile phone number and verifying your purchases. We may also send you Service notifications by other means (for example, by in-product messages). Data or messaging rates may apply when receiving notifications via SMS.
p) Support. Customer support for some Services is available at https://www.ServiceEdgeMarketing.com. Certain Services may offer separate or additional customer support, subject to the terms available, unless otherwise specified. Support may not be available for preview or beta versions of features or Services. The Services might not be compatible with software or services provided by third parties, and you are responsible for familiarising yourself with compatibility requirements.
r) For consumers living in Australia: If you are using a good or service that is subject to the Telecommunications Consumer Protection Code, you are entitled to use an Advocate to communicate with ServiceEdge Marketing; a person acting as your Advocate has no power to act on your behalf or access your information without your presence and agreement to such action. You are also entitled to appoint an Authorised Representative that has the power to access your information and act on your behalf as your agent.
s) Ending your Services. If your Services are cancelled (whether by you or us), first your right to access the Services stops immediately and your licence to the software related to the Services ends. Second, we’ll delete Data or Your Content associated with your Service or will otherwise disassociate it from you and your ServiceEdge Marketing account (unless we are required by law to keep it, return it or transfer it to you or a third party identified by you). As a result, you may no longer be able to access any of the Services (or Your Content that you’ve stored on those Services). You should have a regular backup plan. Third, you may lose access to products you’ve acquired. If you have cancelled your ServiceEdge Marketing account and have no other account able to access the Services, your Services may be cancelled immediately.
4. Billing and Payments
a) Services and Subscription Plans: We offer monthly and yearly subscription options, and other tailored services. Fees and features are detailed on our website and or by quote and may be updated with prior notice. Continued use after such changes constitutes acceptance.
b) Payments: Payments are securely processed via STRIPE. By subscribing, you authorize us to charge your selected payment method.
c) Currency: Prices are quoted in United States Dollars (USD) and is inclusive of tax, unless quoted otherwise.
d) Refunds: Due to the nature of our products and services, we do not provide refunds. Subscriptions can be cancelled anytime, and charges stop after cancellation.
e) Payment Terms. If you purchase a Service, then these payment terms apply to your purchase and you agree to them.
i. Charges. If there is a charge associated with a portion of the Services, you agree to pay that charge in the currency specified. The price stated for the Services excludes all applicable taxes and currency exchange settlements, unless stated otherwise. All prices for Skype paid products are inclusive of applicable taxes, unless otherwise stated. You are solely responsible for paying such taxes or other charges. You are responsible for ensuring that this address is up to date and accurate. We may suspend or cancel the Services if we do not receive an on time, full payment from you. Suspension or cancellation of the Services for non-payment could result in a loss of access to and use of your account and its content. Connecting to the Internet via a corporate or other private network that masks your location may cause charges to be different from those displayed for your actual location. Depending on your location, some transactions might require foreign currency conversion or be processed in another country. Your bank might charge you additional fees for those services when you use a debit or credit card. Please contact your bank for details.
ii. Your Billing Account. To pay the charges for a Service, you will be asked to provide a payment method at the time you sign up for that Service. For all Services, you can access and change your billing information and payment method by signing into your account portal. Additionally, you agree to permit ServiceEdge Marketing to use any updated account information regarding your selected payment method provided by your issuing bank or the applicable payment network. You agree to promptly update your account and other information, including your email address and payment method details, so we can complete your transactions and contact you as needed in connection with your transactions. Changes made to your billing account will not affect charges we submit to your billing account before we could reasonably act on your changes to your billing account.
iii. Billing. By providing ServiceEdge Marketing with a payment method, you (i) represent that you are authorized to use the payment method you provided and that any payment information you provide is true and accurate; (ii) authorize ServiceEdge Marketing to charge you for the Services or available content using your payment method; and (iii) authorise ServiceEdge Marketing to charge you for any paid feature of the Services you choose to sign up for or use while these Terms are in force. We may bill you (a) in advance; (b) at the time of purchase; (c) shortly after purchase or (d) on a recurring basis for subscription Services. Also, we may charge you up to the amount you have approved, and we will notify you in advance of any change in the amount to be charged for recurring subscription Services. We may bill you at the same time for more than one of your prior billing periods for amounts that haven't previously been processed.
iv. Recurring Payments. When you purchase the Services on a subscription basis (e.g., monthly or annually), you agree that you are authorising recurring payments, and payments will be made to ServiceEdge Marketing by the method and at the recurring intervals you have agreed to, until the subscription for that Service is terminated by you or by ServiceEdge Marketing. You must cancel your Services before the next billing date to stop being charged to continue your Services. We will provide you with instructions on how you may cancel the Services. By authorising recurring payments, you are authorising ServiceEdge Marketing to process such payments as either electronic debits or fund transfers, or as electronic drafts from your designated account (for Automated Clearing House or similar payments), or as charges to your designated account (for credit card or similar payments) (collectively, "Electronic Payments"). Subscription fees are generally charged in advance of the applicable subscription period. If any payment is returned unpaid or if any credit card or similar transaction is rejected or denied, ServiceEdge Marketing or its service providers reserve the right to collect any applicable return item, rejection or insufficient funds fee and process any such payment as an Electronic Payment.
v. Online Statement and Errors. For all Services, ServiceEdge Marketing will provide you with an online billing statement on the your account platform, where you can view and print your statement. If we make an error on your bill, you must tell us within 90-days after the error first appears on your bill. We will then promptly investigate the charge. If you do not tell us within that time, you release us from all liability and claims of loss resulting from the error and we won't be required to correct the error or provide a refund, unless otherwise required by law. If ServiceEdge Marketing has identified a billing error, we will correct that error within 90 days. This policy does not affect any statutory rights that may apply.
vi. Refund Policy. Unless otherwise provided by law or the terms of a particular Service offer, all purchases are final and non-refundable. If you believe that ServiceEdge Marketing has charged you in error, you must contact us within 90 days of such charge. No refunds will be given for any charges more than 90 days old, unless otherwise required by law. We reserve the right to issue refunds or credits at our sole discretion unless otherwise required by law. If we issue a refund or credit, we are under no obligation to issue the same or similar refund in the future. This refund policy does not affect any statutory rights that may apply. If you live in Taiwan or Israel, please note that according to the Consumer Protection Act and its relevant regulations, all purchases pertaining to digital content provided via intangible form and/or on-line services are final and non-refundable when such content or service has been provided online. You are not entitled to claim any cooling off period or any refund.
vii. Cancelling the Services. You may cancel a Service at any time, with or without cause. Cancelling paid Services stops future charges to continue the Service. To cancel a Service and request a refund, if you are entitled to one, visit the ServiceEdge Marketing account management website. You should refer back to the offer describing the Services as (i) you may not receive a refund at the time of cancellation; (ii) you may be obliged to pay cancellation charges; (iii) you may be obliged to pay all charges made to your billing account for the Services before the date of cancellation; and (iv) you may lose access to and use of your account when you cancel the Services; or, if you live in Taiwan or Israel, (v) you may receive a refund in the amount equal to the unused fees you paid for a Service calculated at the time of cancellation. Please contact a ServiceEdge Marketing to obtain a refund if you are eligible for it. We will process your Data as described. If you cancel, your access to the Services ends at the end of your current Service period or, if we bill your account on a periodic basis, at the end of the period in which you cancelled. If you initiate a chargeback or reversal with your bank for your payment of Services, we will deem you to have cancelled as of the date that the original payment was made, and you authorise us to immediately cancel your service and/or revoke any content that was provided to you in exchange for such payment.
viii. Trial-Period Offers. If you are taking part in any trial-period offer, you are required to cancel the trial Service(s) within the timeframe communicated to you when you accepted the offer in order to avoid being charged to continue the Service(s) at the end of the trial period.
ix. Promotional Offers. From time to time, ServiceEdge Marketing may offer Services for free for a trial period. ServiceEdge Marketing reserves the right to charge you for such Services (at the normal rate) if ServiceEdge Marketing determines (in its reasonable discretion) that you are abusing the terms of the offer.
x. Price Changes. We may change the price of the Services at any time and if you have a recurring purchase, we will notify you by email, or other reasonable manner, at least 15 days before the price change. If you do not agree to the price change, you must cancel and stop using the Services before the price change takes effect. If there is a fixed term and price for your Service offer, that price will remain in force for the fixed term.
xi. Payments to You. If we owe you a payment, then you agree to timely and accurately provide us with any information we need to get that payment to you. Subject to applicable law, you are responsible for any taxes and charges you may incur as a result of this payment to you. You must also comply with any other conditions we place on your right to any payment. If you receive a payment in error, we may reverse or require return of the payment. You agree to cooperate with us in our efforts to do this. We may also reduce the payment to you without notice to adjust it for any previous over-payment.
xii. Gift Cards. Redemption and use of gift cards are governed by this terms and conditions agreement.
5. Term, Termination, and Suspension
a) Agreement term and termination. The term of this Agreement begins when you accept it. You may terminate this Agreement at any time by deleting your profile. Upon termination of this Agreement your contact information and preferences will be removed; your optional free subscription to ServiceEdge Marketing 365 Developer obtained under this Agreement will end and your access to Developer Services will end.
b) Regulatory. In any country where any current or future government regulation or requirement that applies to us, but not generally to businesses operating there, presents a hardship to us operating the Services without change, and/or causes us to believe this Agreement or the Services may be in conflict with any such regulation or requirement, we may change the Services or terminate the Agreement. Your sole remedy for such changes to the Services under this Section is to terminate this Agreement.
c) Suspension or Termination. We may suspend or terminate your use of the Services if: (1) reasonably needed to prevent unauthorized access to Customer Data; (2) you fail to respond to a claim of alleged infringement within 7 days; (3) you violate this Terms and Conditions Agreement, our Privacy Policy, and or any other policies; or (4) we suspect fraud. We will attempt to suspend access to the minimum necessary part of the Services while the condition or need exists. We will give notice before we suspend, except where we reasonably believe we need to suspend or terminate immediately. If you do not fully address the reasons for the suspension within 60 days after we suspend, we may terminate this Agreement and delete your d.
d) Your Cancellation: Cancel your subscription through your account settings. Access will continue until the end of the current billing period.
e) Termination by Us: We reserve the right to suspend or terminate access for violations of these Terms or applicable laws.
6. Disclaimer of Warranties
EXCEPT AS WARRANTED IN A SEPARATE AGREEMENT, SERVICEEDGE MARKETING AND ITS RESPECTIVE SUPPLIERS PROVIDE THE SERVICES (INCLUDING THE CONTENT, APPS AND APIS, AND CONSULTING SERVICES) “AS IS,” “WITH ALL FAULTS” AND “AS AVAILABLE.” YOU BEAR THE RISK OF USING IT. WE PROVIDE NO WARRANTIES, GUARANTEES OR CONDITIONS, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. YOU MAY HAVE ADDITIONAL RIGHTS UNDER YOUR LOCAL LAWS WHICH THIS AGREEMENT CANNOT CHANGE. THESE DISCLAIMERS WILL APPLY TO THE FULLEST EXTENT PERMITTED UNDER APPLICABLE LAW, INCLUDING APPLICATION TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
Third party content and materials. SERVICEEDGE MARKETING DOES NOT CONTROL, REVIEW, REVISE, ENDORSE, OR ACCEPT RESPONSIBILITY FOR ANY THIRD-PARTY CONTENT, INFORMATION, MESSAGES, MATERIALS, PROJECTS ACCESSIBLE FROM OR LINKED THROUGH THE SERVICES, AND, EXCEPT AS WARRANTED IN A SEPARATE AGREEMENT, SERVICEEDGE MARKETING MAKES NO REPRESENTATIONS OR WARRANTIES WHATSOEVER ABOUT AND SHALL NOT BE RESPONSIBLE FOR ANY OF THE FOREGOING. ANY DEALINGS YOU MAY HAVE WITH SUCH THIRD PARTIES ARE AT YOUR OWN RISK.
7. Defense of claims and Indemnification
a) You agree to indemnify and hold harmless ServiceEdge Marketing from any claims or damages arising from your use of the Services.
b) Limitations. Our obligations will not apply to a claim or award based on: (1) Customer Data, Non-ServiceEdge Marketing Product, modifications you make to the Services, or materials you provide or make available as part of using the Services; (2) your combination of the Services with, or damages based upon the value of, a Non-ServiceEdge Marketing Product, data or business process; (3) your use of a ServiceEdge Marketing trademark without our express written consent, or your use of the Services after we notify you to stop due to a third-party claim; or (4) your redistribution of the Services to, or use for the benefit of, any unaffiliated third party.
8. Limitation of liability
Limitation. The aggregate liability of each party under this Agreement is limited to direct damages up to One United States dollar ($1.00 USD).
EXCLUSION. NEITHER PARTY, NOR ITS SUPPLIERS WILL BE LIABLE FOR LOSS OF REVENUE, LOST PROFITS, OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, EVEN IF THE PARTY KNEW THEY WERE POSSIBLE.
The limits of liability in this Section apply to the fullest extent permitted by applicable law.
9. Intellectual Property
All content on the Platform, including software, text, and graphics, is owned by ServiceEdge Marketing or its licensors and is protected by Australian and international laws.
10. User Conduct
Users must not:
a) Access the Platform without authorization.
b) Transmit harmful code.
c) Disrupt the Services.
11. Disclaimers
a) No Warranties: Services are provided "as is" without guarantees of uninterrupted or error-free operation.
b) Limitation of Liability: We are not liable for indirect, incidental, or consequential damages.
12. Indemnification
You agree to indemnify and hold harmless ServiceEdge Marketing from any claims or damages arising from your use of the Services.
13. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Disputes are subject to the jurisdiction of NSW courts.
14. Reservation of Rights
ServiceEdge Marketing reserves the right to refuse service, amend, vary, or supplement these Terms at any time. Changes become effective upon posting to our website. Your continued use signifies acceptance.
15. Miscellaneous
a) No additional rights granted. We reserve all rights not expressly granted under this Agreement, and no other rights are granted under this Agreement by implication or estoppel or otherwise.
Assignment. You may not assign this Agreement either in whole or in part.
b) Severability. If any part of this Agreement is held unenforceable, the rest remains in full force and effect.
Waiver. Failure to enforce any provision of this Agreement will not constitute a waiver.
c) No agency. We are independent contractors. This Agreement does not create an agency, partnership or joint venture.
d) No third-party beneficiaries. There are no third-party beneficiaries to this Agreement.
e) Applicable law and venue. This Agreement is governed by the laws of the State of New South Wales, Australia, without regard to its conflict of laws principles. Any action to enforce this Agreement must be brought in the courts of New South Wales, Australia.
f) Entire agreement. This Agreement is the entire agreement concerning its subject matter and supersedes any prior or concurrent communications.
g) Australian export jurisdiction. The Services are subject to Australian export jurisdiction. You must comply with all applicable laws, including the Australian Export Regulations, the International Traffic in Arms Regulations, and end-user, end-use and destination restrictions issued by Australia. and other governments. h) International availability. Availability of the Services, including specific features and language versions, varies by country.
i) Force majeure. Neither party will be liable for any failure in performance due to causes beyond its reasonable control (such as fire, explosion, power blackout, earthquake, flood, severe storms, strike, embargo, labor disputes, acts of civil or military authority, war, terrorism including cyber terrorism), acts of God, acts or omissions of Internet traffic carriers, actions or omissions of regulatory or governmental bodies (including the passage of laws or regulations or other acts of government that impact the delivery of Services).
j) Modifications. We may modify this Agreement at any time with or without individual notice to you by posting a revised version on our website at www.serviceedgemarketing.com. Any modifications will be effective upon your continued use of a Service.

17. Definitions
Any reference in this agreement to “day” will be a calendar day.
“Affiliate” means any legal entity that a party owns or that owns a party, with a 50% or greater interest. “Content” means documents, photographs, videos, and other graphical, textual, or audio-visual content that may be subject to copyright protection.
“Customer Data” means any Content or other data, including all text, sound, video, or image files, or software, that are provided to us by, or on behalf of, you through your use of Services for use by you or your authorized users.
“ServiceEdge Marketing Content” means Content on the Services provided by ServiceEdge Marketing and its suppliers.
“ServiceEdge Marketing Software” means ServiceEdge Marketing software and computer code, including sample code and Developer Services Software.
“Non-ServiceEdge Marketing Product” is any software, data, service, website or other product licensed, sold or otherwise provided to you by an entity other than us, whether you obtained it via our Services or elsewhere.
“Preview” means preview, beta, or other pre-release versions of Software and Services offered by ServiceEdge Marketing.
“Privacy Policy” means the Services privacy policy (https://www.serviceedgemarketing.com/privacy-policy).
“Services” means any and all products, software and services provided by ServiceEdge Marketing and our suppliers that we make available to you under this Agreement.
“Subscription/User Plan” means a per-user based subscription, trial, or other ServiceEdge Marketing granted benefit that permits access to and account services for the Services.
“we” and “us” means ServiceEdge Marketing, Kingsford, New South Wales 2032, Australia, and its Affiliates and Suppliers as appropriate.
“you” and “your” means the person or entity accepting this Agreement to use the Services.
